Act It Out licenses a drama program to dance studios and early learning centres. The program is licensed by Act It Out Pty Ltd (ACN 699 067 484, ABN 78 699 067 484), and in these terms “we” and “us” mean that company.

These terms cover this website and anything you download or buy through it.

If your school holds a licence with us, you also have a signed licence agreement. That agreement governs your licence. Where it says something different to this page, the agreement is the one that counts.

By using this site you accept these terms. If you do not, please do not use it.

Using the site

The site is here for people considering the program and for schools already running it. Please use it for that.

Do not copy the site or its content for your own commercial use, do not scrape it, and do not try to reach parts of it you have not been given access to.

What is on the site is general information. Prices, start dates and program content change. A written quote from us is the thing to rely on, not a web page.

Program guides and free material

When you download a guide or a free lesson you give us your name and email, and we will email you about the program. Every email has an unsubscribe link and it works. What we do with your details is set out in our privacy policy.

The guides are for you and your team to read. Please do not republish them or pass them on to another school.

Buying a licence

A licence has two charges:

1. A licensing fee, sometimes called the setup deposit. Paid in full up front, or in monthly instalments until it is cleared.
2. A monthly fee, which starts when you sign up and continues while your licence runs.

Prices we quote are exclusive of GST unless we say otherwise. GST applies. Invoices are due within 14 days.

Paying does not start your licence. We grant access to the program once the licence agreement is signed, and no earlier than 14 days before your agreed start date. If you pay and then do not sign, we will refund what you have paid less an administration fee. That fee is set out in your quote and in the agreement.

The program itself

Everything we supply stays ours: lesson plans, videos, music, images, teacher resources, the Act It Out name and the logo. Your licence is permission to run the program at your school. It is not a transfer of ownership and it does not let you sell, share or rebuild any of it.

If you hold a licence, the agreement requires you to run the program under the Act It Out name and to deliver it as supplied. Those terms are in the agreement, not here.

Your login

Your school's login is for the people you have nominated. Do not share it more widely, and tell us if you think someone else has it.

We can suspend or withdraw access if the agreement is breached. The agreement sets out how, and what happens first.

Availability

We use Kajabi to host the site and the program. We would like both to be available all the time and mostly they are, but we cannot promise it. We are not liable for loss caused by the site or the app being unavailable.

Some pages link to other people's sites. We do not control those and we are not responsible for what is on them.

Your rights under Australian Consumer Law

Nothing here takes away rights you have under the Australian Consumer Law. Our services come with guarantees that cannot be excluded.

Beyond those guarantees, our liability to you is limited to supplying the service again or refunding what you paid for it. We are not liable for indirect loss, lost profits or lost enrolments.

Changes

We will update this page when what we do changes, and the date at the top will change with it. If a change affects a licence you already hold, we will tell you.

Governing law

These terms are governed by the laws of New South Wales, Australia.
